Rights to Grandmother's Estate

My wife and her mother. Do my daughter and I have any rights when my wife dies?

I think this listener means “if my wife dies before me do my daughter and myself have any rights to my wife’s estate and anything she is willed by her mother”.

An estate is that which she (Listener's wife) owns at the date of her death.  The simple answer to this is if her mother dies first then anything she receives from her mother is included in your wife’s estate.  If on the other hand her mother survives her daughter (your wife) then her mother is free to make whatever will she chooses without regard to her daughter, her grand-daughter or her son-in-law.

The issues raised in the answer to this NewsTalk listener's question are dealt with in a general way as can only be the case on live radio.
