Service of Court Summons

Does an RTA (Road Traffic Accident) summons have to be served directly to the accused? In my case it was served on a family member who is elderly and the summons was misplaced.

No. The summons does not have to be served personally.  It must be delivered by hand or left with someone at the address.    It used to be the case where summons had to be served on the accused by hand in person by a Garda but this created administrative problems for the Guards and it was solved by bringing in this rule.    

 

This of course causes problems for defendants because if they don’t get the summons for whatever reason and then they don’t turn up in court there can be serious penalties imposed in their absence.  You then have to appeal.   Taking an appeal from the District Court to the Circuit Court should be handled by a criminal law solicitor and should be done within 14 days of the original court case.
