Wage cut without consent

Can employers reduce wages without employees agreement? James (Cork)

No James and it is as simple as that but clearly your employer may be engaged in a consultation process proposing a reduction in wages across the board without having to make redundancies.   If there is a relatively small wage cut proposed,  the law will probably not see this as a threat to you but if you refuse it, it's possible that you and others will have their positions made redundant.

 

If the employer were to impose wage cuts then you could ask a Rights Commissioner to give a Ruling on it and seek to enforce your contract.

If the cut was very substantial (such as 50%) it may be seen as a constructive dismissal and you could bring a case for unfair dismissal to the Employment Appeals Tribunal.   

 

If you do have a wage cut imposed on you my advice is to consult an Employment Law Solicitor to look carefully at the options.
