Girlfriend's mortgage obligation

Please help. If my ex-girlfriend has stopped paying her half of the mortgage repayments for the last eighteen months, can I take her to Court? She has also left Ireland.

The legal situation here is that when this listener and his girlfriend bought the property, they implicitly covenanted with each other to pay 50% of the mortgage each and now she has welshed on that.  The answer is yes, this listener can take his girlfriend to Court and seek an indemnity for the money he is paying effectively on her behalf.

The real problem here is a practical one – she has left Ireland and Irish Court proceedings will have to be served on her by a special order of the Irish Courts.

This listener should talk to a litigation expert who has experience in dealing with property disputes.

The issues raised in the answer to this NewsTalk listener's question are dealt with in a general way as can only be the case on live radio. Before relying on the advice given in this answer, whether you heard the broadcast or are for the first time reading the issues here please do not rely on the broad advice given. For a detailed professional opinion please consult a qualified legal advisor and for further details read our disclaimer on the Home Page.
