Advocacy worker barred from Mental Hospital

Can an Advocacy worker be barred from visiting psychiatric clients in Mental Hospitals when requested by clients. I am not allowed in because I was addressing issues on patients’ behalf. Ask legal eagle can Clinical Director do this? Kilkenny Listener.

I suspect from this question that there is conflict between the Clinical Director on the one hand and the Listener on the other as to the manner in which the issues are being addressed on behalf of patients. The single most important obligation on the Clinical Director is that of the patient’s mental care and treatment.   I suspect that the Director will say that this is being compromised by this Listener.  Clearly the Listener will have other views.

If this is a HSE facility there is a patient charter that is clearly available, with dispute resolution procedures which should be engaged.

If ultimately these cannot be sorted, this Listener if she had cause to believe that  patients were being mistreated or their detention was unlawful - she could apply for a Writ of Habeas Corpus to the High Court whereupon the High Court would be obliged to conduct a full investigation into the circumstances of the detention of the patient.
