Probationed Offender shouting abuse

A fellow who is on probation for assault is shouting slanderous remarks at me on the street. What are my options?

Someone who is on probation may also have signed a Bond declaring that they would be of good behaviour and would keep the peace.   This is known as ‘being bound to the peace’

In my opinion this activity breaks the Bond and it can be revoked probably resulting in his being put in Prison.

This listener should keep records of incidents (time, date, place, and words shouted etc) and then talk to the Probation Service,  find out what the terms of his probation are and ask the Probation Officer to look into it.

If that does not work go and see the Clerk of the Court and explain the position to him/her.The Clerk will report the matter to the Judge.

As a footnote, if this listener was involved in the original case (say as a witness), the Defendant’s conduct will be viewed much more seriously by the courts.
