Serving Book of Evidence

Can Book of Evidence be served to Solicitor representing client instead of Defendant? Larry.

Hi Larry,  

In theory this is possible with written consent of a Defendant but I have never seen it done because the Defendant is usually before the Court when the Book of Evidence is ready and is served on him or her directly.

The direct service of the Book of Evidence on the Defendant is an important safeguard in protecting the State’s case to prevent a plea by the Defendant and his or her Solicitor that the Defendant was never given a copy of the Book of Evidence and then when the case goes forward for hearing there might be grounds for a mis-trial.
