Probate 12 years after Dad's death

How much does it cost to take out Probate? Dad had no money – just his house – but it is 12 years ago. I was told I should have taken out Probate but never did. Is there a problem?

Hi Ann,

I don’t think there is a problem but you should take out Probate now.  You can choose to use a solicitor who will represent you with the application to the Probate Office and give you advise on Inheritance Tax and Succession Law. Because of the length of time past there may be undeclared inheritance tax issues – your solicitor will let you know at the first meeting. To wind up the estate, a solicitor will charge between 1% and 3% of the value of the estate depending on the work to be done. Some solicitors will charge at an hourly rate. If your Dad had a solicitor, go see him or her.

If you have the time you can choose to go to the Personal Application Section of the Probate Office and do the job yourself.  This takes longer and the Probate Office do not give you representation or tax or other advice.

To take out probate yourself, the Probate office will charge a sliding scale of court duty - for example, €297.00 for an estate of €500,000.00.
