Management Company Woes

I live on an estate with a management company. The electronic gates almost never work and the number of CCTV cameras has been drastically reduced. In spite of gangs of teenagers and children vandalising the estate we are paying €1,000 for this. Joe, Wexford.

Hi Joe.  This is a recurring theme on this programme – about management companies not doing their job and yet the tenants getting full bills for their contributions.

I have to say that under the terms of your legal title it is normally the case where you are obliged to pay the full service charge every year regardless of the bad value you are getting.  The solution to your problem is to get a number of residents together and take over the management company, and in so doing fire the service providers that have been engaged.  Then run the thing yourselves on a sub-contract basis and get the job done.

Regarding taking over the management company, ordinary company law applies and you can call for an extraordinary general meeting to dismiss the Board of Directors and have you and your colleagues installed in their place.  This will give you complete control over the management company and you can take it from there.

Don't be afraid of doing this. It's surprising how straightforward it is and the help that's available from others in similar situations.
