Cost of "Drafting up papers" for site

Radio Lawyer, how much work is involved in “drafting up papers” for a site transfer? I want to switch Solicitors but the old one has done this. Can he not just give them to the new Solicitor or throw them away? Sinead, Kilkenny.

Hi Sinead.  It is my guess from what you say that your first Solicitor has prepared contracts for the sale of the site or, if you are going to buy it, then he has received papers and has drafted some of the transfer documents

There should be no problem in your switching Solicitors but you will have to pay the first Solicitor for the work done to date.  Without looking at the file it sounds to me that he has done somewhere between one third and a half of the work and therefore would be entitled to fees calculated on one third or a half of the total that would be payable if the case had gone ahead in his hands. 

But the first Solicitor having done this work will be an advantage to your second Solicitor because he won’t have to re-do all the work that has been done in the first case, so your new Solicitor should be charging less.
