Stabbed outside Pub

Was stabbed outside pub by person who was served in pub and caused trouble in pub where do I stand?

We all know that stabbing offences are increasing at a frightening rate and the chances of being stabbed get worse where drink or drugs are involved. In this case add this to aggression that has already occurred inside the Pub and the chances have increased even more.

Of course the assailant with the knife is legally responsible – to the State in criminal law and to you, the victim under civil law to pay compensation. But a criminal like that is unlikely to have the money to pay compensation. That’s not the point – we must see if the Pub owners are liable to pay compensation.

The answer to this Listener’s question largely depends on what he means by “outside the Pub” -   in other words was it still on Pub premises such as the carpark?

No Publican is responsible for the unexpected outbust of violence of any patron but if a Publican knows or reasonably ought to know that violence is likely to occur to one of it’s customers then they have a duty of care to ensure that it does not happen.   This is why Bouncers are hired.    It depends entirely on what the trouble inside the Pub was.   It also depends on how this Listener became involved and it depends on what the conduct of the Bouncers outside was and whether or not it was on Pub property.   The question is too short to give a detailed answer.  You should go to a Solicitor and ask if they will give you the first consultation free.    Solicitors are forbidden from advertising this type of service but are allowed to give it if asked for.
