Fired from senior post.

Fired from senior post. Can I sue?

It depends on why you were fired and what the terms of your contract of service are. You will find the details of your contract in the letter from your employers that you would have received when you started work. Either this letter or a handbook in the Company should provide grievance and disciplinary procedures laid out.   It is pretty much the case that no one can be dismissed without proper disciplinary procedures being taken against them -  these include being told that you have done something wrong,   details of that mistake being made known to you,  the evidence involved  (people who complained etc),  any documents or other paper trail involved and giving you the opportunity to have a disciplinary hearing  including the right to call witnesses,  refute any evidence put to you and to make submissions.

If the correct procedure is not followed it is normally the case that your dismissal will be unfair in Law and you can sue. Your position is (or was) a senior one and presumably with it carried a good salary with possible bonus, pension entitlements and expenses. Believe me when I say that it will be worth your while to see a specialist Employment Law Solicitor and take advice as soon as possible. There are very tight time limits under the Unfair Dismissals Act and you shouldn’t delay in taking advice.

The issues raised in the answer to this NewsTalk listener's question are dealt with in a general way as can only be the case on live radio.
