 A small lorry crashes into the back of your car while you are stopped at traffic lights. As a result you have €3,000 property damage. The other driver wants to “fix it up” himself without using his insurance company. Should you let him?

 While a passenger in a friend’s car you suffer a broken arm when a van pulls out of a lane and hits your side. You will be out of work for 6 weeks and your boss says that he cannot pay your wages while recovering. You have many expenses and the insurers still are not ready to pay out - what can you do?

 Your mother is waiting to cross the road at pedestrian lights. When she gets “the green” she steps out, a car seems to come from nowhere and narrowly misses her. Unfortunately the fright she gets causes her to fall and break her hip yet the car does not stop. What can be done?

NEWS OF INSURANCE COMPANY MISCONDUCT

We have received reports from our clients and from other solicitors, of illegal practices by insurance company officials in the days following a crash. These reports suggest that an official from the insurer of the guilty driver in the accident will visit a victim in hospital or at home without warning and offer a small settlement while the victim is in a vulnerable state (in one case just then coming out of anaesthetic) and require them to sign a waiver. Be particularly careful not to talk to these people or others seeking information. Above all and no matter what they say please don’t sign anything. Refer their questions on to us and we will deal directly with them. If they are genuine they will be happy to work with us in answering their queries.

AFTER AN ACCIDENT...........

 DO:  Stop!  Every driver is obliged to stop immediately they are involved in an accident. They must give personal details as well as vehicle and insurance particulars to the Gardai, to the other parties to the accident and anyone in charge at the scene.

 DO:  Get urgent medical help if injured. Do not say “I’ll be alright”. Maybe you will but get a doctor to say that.

DO:  Get the registration numbers of all vehicles involved as well as names and addresses of all drivers and witnesses.

DO:  Report the accident to the Gardai as soon as possible if they do not attend the scene.

 

DON’T: Ignore medical advice. Follow your doctor’s instructions precisely.

DON’T: Make any statement to anyone and don’t sign anything other than for your insurer without legal advice.
